The NMC bar on MBBS internships at other colleges is challenged.

 

The Gujarat High Court issued a notice to the National Medical Commission and NHL Medical College on Tuesday in response to a petition by a medical student to allow her internship at any medical college in Vadodara. The student has completed MBBS at NHL College but wants to do an internship at Vadodara.  She challenged the new rules enacted in 2021 that require medical students to do internships only in medical schools that have completed MBBS courses. However, according to students, the old rules from 1997 allowed her to be an intern at any medical college in India, so the new rules cannot be enforced retroactively. 

 

 The petitioner, Shruti Gupta, enrolled in the city’s NHL Medical College from 2017 to 2018 and received a four-and-a-half-year degree from MBBS in March 2022. According to the new rules, she must complete a 12-month internship at the hospital attached to the medical school. Her lawyer, Mitul Shelat, said she had an MBBS degree in accordance with the 1997 Graduate School of Medicine Regulations. This will allow you to complete a 12-month compulsory internship at an accredited medical college or hospital in India. Despite the regulations, her application for an internship at a hospital in Vadodara was not considered by the authorities. Her lawyer claimed that after the National Medical Commission Act (NMC Act) was enacted in 2019, the National Medical Commission drafted the National Medical Commission (Forced Rotation Medical Internship) rule in 2021. However, the rules do not apply to students who have already completed the MBBS course under the 1997 rules. Section 49 NMKG explicitly states that students who complete their studies before the law comes into force have the right to continue and complete their studies according to the curriculum that existed before the law came into force. Therefore, her research course is regulated by old laws and underlying ordinances, and the applicable regulations do not apply to the petitioner at all. The petition also alleged that the ordinance was not submitted to Congress in accordance with the procedures stipulated by law, thus violating the provisions of the law. Therefore, according to the old law, she should be allowed to do a medical internship in Vadodara, it said.
