How to get a Spouse Dependent Visa in Canada? 

A spouse open work permit allows an international student’s partner to work anywhere in Canada.

Your spouse can move with you to Canada if you are an international student studying in Canada with a valid study permit. He or she will not need to enrol themselves in any type of course in Canada.

Before or after they arrive in Canada, they can apply for a spousal open work permit. The length of the work permit is the same as the length of the study permit.

Sometimes The processing for the spouse work permit can occur at the same time as the study permit if that is the case you can fill out the application form after paying the fee associated with a permit application. Your spouse can also apply for the permit when they reach the border or airport in Canada.

Let’s look at how to apply for an open work permit.

Applying for an open work permit when the spouse is outside of Canada.

• Visit the IRCCs website to check for the eligibility
• After completing the questionnaire you will be given a personal reference code that needs to be noted down.
• Log in to your profile which is called  My CIC. If you do not happen to have one you can register an account called GC key. You will need to include your Universal Client ID which can be found on the study permit.
• Fill out the application form
• After filling out the application form save your file on your desktop and upload the pdf file to your application. If you see a field that requires you to fill out the information about having a job offer, enter N/A or not applicable.

 Furthermore, because open work permits for spouses of international students are not required in Canada, you can leave the LMIA section blank when filling out the application form.

•  Upload the IMM5710 form to your application. Please make sure to include all the pages of stamped/ marked pages of your passport when asked to upload a scan of your passport in one single pdf.

Sometimes you may be required to attach medical exam documents. Upload it in the section of additional documents.

• pay the spouse open work permit fees of CAD 255 – $155 for the processing fee and CAD 100 for the open work permit holder fee.

Applying for an open work permit when the spouse is in Canada.

• To know whether you are eligible to apply for an open work permit for your spouse you need to go to Canada’s official website and check your eligibility.
• Answer the questionnaire and get your referral code.
• Login to your MyCIC profile and make sure to note your UCI
• Fill out and complete the pdf application form. If you are unable to open the file, you must download the most recent version of Adobe Reader software.
• Upload the completed PDF file to your online application after saving it to your computer.
• You don’t need a job or LMIA to apply for an open spousal work permit so leave the sections blank.
• Attach the IMM5710 form to your application.
• When you are asked to include a scan of your passport and medical examination documents, follow the steps outlined above.
• Pay the fees, which will amount to CAD255 in total.

Wait for the notification from IRCC.

1. A copy of your study permit
2. Letter  of enrollment o any study program
3. A copy of your marriage certificate
4. Proof that you have enough funds
5. A complete copy of your spouse’s passport including all the stamped and marked pages.

Processing time 

According to the CIC website, the processing time for the permit is 4 to 5 months. During this period, your spouse must maintain their legal status as a visitor, student, or worker until the final decision allowing him or her to begin working is made.
